Terms of Service

1. Agreement and eligibility

These Terms are a binding agreement between you and Colzera, which operates Colzera ("Colzera," "we," "us," or "our"). They govern Colzera's websites, accounts, interior-design tools, generated concepts, interactive walkthroughs, exports, sharing, billing, and related services (the "Service").

By creating an account, accepting these Terms, purchasing, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. You must be at least 18 and legally able to enter a contract. If you use Colzera for an organization, you represent that you can bind it.

2. The Service and design limitations

Colzera helps users describe interior spaces, generate design concepts and estimated budgets, and create browser-based interactive walkthroughs. The Service uses probabilistic artificial intelligence and automated rendering. It can misunderstand instructions, omit details, depict physically impractical conditions, or produce measurements, materials, colors, availability, and costs that differ from real-world results.

Design concepts and walkthroughs are visualization aids, not construction documents. Apparent dimensions and finishes may not be accurate to scale unless independently verified. Lighting, screens, source photographs, and rendering can materially change the appearance of color and material.

Colzera does not provide architectural, engineering, code-compliance, permitting, surveying, appraisal, contractor, or other regulated professional services. Before buying materials or beginning work, verify dimensions, structural conditions, building codes, accessibility, product specifications, pricing, and feasibility with qualified professionals.

3. Accounts and security

Provide accurate information, protect your credentials, and promptly notify support of suspected unauthorized access. You are responsible for activity under your account unless caused by our breach. You may not share an individual account to avoid limits, impersonate another person, or transfer credits or plan access without permission.

4. Walkthrough Credits

One Walkthrough Credit permits one complete connected walkthrough project. Large homes, disconnected spaces, or materially separate projects may require more than one credit. A credit is consumed when walkthrough generation begins.

Credits purchased in one-time packs or subscriber top-ups do not expire while the account remains active. Subscription credits are added only after a successful subscription invoice, roll over only while the plan remains active, and are capped at 15 for Pro or 60 for Studio. When a plan ends, unused subscription credits expire; purchased credits remain. Credits are non-transferable and have no cash value.

If our generation system fails before producing a usable result, Colzera automatically restores the consumed credit and records the refund in the credit ledger. A change of mind, dissatisfaction with an aesthetic direction, or a restart requested after a usable result is produced does not automatically qualify for a credit refund.

5. Purchases, subscriptions, and renewal

Prices, pack quantities, plan allowances, rollover caps, top-up eligibility, editing periods, and included features appear on the Pricing page and at Stripe Checkout. Taxes may be added where required.

One-time packs are charged once. Pro and Studio renew automatically each month until canceled. You may cancel online in Billing or Stripe's Customer Portal. Cancellation takes effect at the end of the paid period. Upgrades may be prorated and become effective after Stripe confirms payment. Downgrades take effect at the next billing cycle. Except where law requires otherwise, paid charges are nonrefundable.

If payment fails, we may restrict paid features after notice. If a payment is refunded, reversed, or disputed, we may remove corresponding unused credits, correct the ledger, or restrict the account while the adjustment is reviewed. We may change future pricing with legally required notice; changes do not alter already purchased credits.

6. Your content and property rights

You retain ownership of room photographs, floor plans, measurements, prompts, references, logos, project details, feedback, and other material you submit ("User Content"). You grant Colzera a worldwide, nonexclusive license to host, copy, transmit, transform, process, display, and use User Content only as reasonably needed to operate, secure, support, and improve the Service and comply with law.

You represent that you have the rights and permissions needed to submit User Content, including photographs or plans for a property. Remove people, confidential documents, access codes, alarm details, valuables, and unnecessary sensitive information before upload. Do not submit another person's confidential information without authority.

7. Generated output and commercial use

As between you and Colzera, and to the extent allowed by law, you may use outputs generated for you subject to your plan. Studio includes commercial-use rights and white-label presentation features as described at purchase. AI outputs may not be unique, copyrightable, noninfringing, complete, or fit for a particular purpose.

Product names, materials, prices, estimated budgets, stock, lead times, and third-party links can change. A depicted material is not a guarantee of availability, performance, safety, compatibility, or exact visual match. Verify information with manufacturers, suppliers, contractors, and relevant professionals.

8. Acceptable use

Do not use Colzera to violate law or rights; submit content without permission; facilitate fraud, harassment, discrimination, violence, or exploitation; create malware; bypass security, usage, billing, or access controls; scrape or burden the Service; reverse engineer except where law expressly permits; resell the Service without permission; or use Colzera content or outputs to train a competing model.

Do not use a walkthrough to misrepresent a property's actual condition, hide material defects, or deceive a buyer, tenant, client, insurer, lender, contractor, or regulator. Clearly identify generated or conceptual imagery where a reasonable viewer could mistake it for the completed space.

9. Privacy, providers, and sharing

Our Privacy Policy explains our handling of personal information. Colzera relies on providers including Supabase, Stripe, Vercel, Resend, and AI or rendering services. Third-party services have their own terms and privacy practices.

Anyone with an active share link may be able to view its walkthrough. You are responsible for deciding what to share and with whom. No online system is completely secure; choose content appropriate for the Service and your regulatory needs.

10. Availability, support, and changes

The Service has no guaranteed service level unless a signed order form says otherwise. Maintenance, provider outages, rendering queues, internet failures, security events, and circumstances outside our control can interrupt it. Rendering and priority labels are relative service targets, not guaranteed completion times.

We may improve, add, remove, or change features. For paid users, we will use commercially reasonable efforts to provide notice before materially reducing core purchased functionality. If we permanently discontinue a prepaid service, we may provide a reasonable replacement or legally required prorated remedy.

11. Ownership and feedback

Colzera and its licensors own the Service, software, interfaces, visual design, documentation, trademarks, and related intellectual property, excluding User Content and rights expressly granted to you. If you provide feedback, you grant us a perpetual, worldwide, royalty-free right to use it without compensation.

12. Suspension and termination

You may stop using Colzera and cancel a plan at any time. We may suspend or terminate access for material breach, legal or security risk, nonpayment after notice, or abuse. After termination, your license ends. We may delete or de-identify stored information according to the Privacy Policy, applicable law, backups, and billing record requirements.

13. Disclaimers

To the maximum extent permitted by law, the Service and outputs are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a purpose, title, noninfringement, accuracy, and availability. We do not warrant that a walkthrough is dimensionally exact, buildable, code-compliant, structurally sound, photorealistic, or an exact representation of materials, lighting, cost, or the completed space.

14. Limitation of liability and indemnity

To the maximum extent permitted by law, Colzera and its suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, opportunity, anticipated savings; property damage arising from reliance on a concept; or substitute-service costs. Aggregate liability for claims related to the Service will not exceed the greater of what you paid Colzera during the 12 months before the claim or US $100, except liability that cannot legally be limited.

To the extent permitted by law, you will defend and indemnify Colzera and its personnel from third-party claims arising from your unlawful use, material breach, unauthorized User Content, or misleading use of generated imagery, except to the extent caused by Colzera's breach, negligence, or willful misconduct.

15. Disputes and general terms

Before a formal claim, each party will give written notice and try in good faith for 30 days to resolve it. These Terms are governed by Maryland law, without conflict-of-law rules. Unless mandatory consumer law requires otherwise, disputes will be brought in courts serving Montgomery County, Maryland. Eligible small-claims actions and urgent injunctive relief remain available.

If a term is unenforceable, it will be limited as needed and the rest remains effective. These Terms, the Privacy Policy, checkout disclosures, and any signed order form are the agreement about the Service. A signed order form controls if it expressly conflicts. Provisions concerning payment, ownership, disclaimers, liability, indemnity, disputes, and records survive termination.

16. Changes, notices, and contact

We may update these Terms. Material changes receive reasonable notice by email, in-product notice, or another legally permitted method. Operational, security, billing, and legal notices may be delivered electronically.
